1. Acceptance of Terms

Welcome to Connect Outdoors ("Connect Outdoors," "we," "us," or "our"), a membership management platform operated by Nathen Conrad-Peterson ("Operator").

These Terms and Conditions ("Terms") govern access to and use of the Connect Outdoors Membership Portal ("Portal") by individual members, prospective members, parents or guardians, authorized account managers, club administrators, and other authorized users (collectively, "Users").

By accessing the Portal, creating or managing records, submitting applications, processing payments, or otherwise using the Portal, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, you must discontinue use of the Portal.

 

2. Purpose of the Portal

Connect Outdoors provides technology services that allow participating clubs and organizations ("Clubs") to manage membership-related activities, including:

  • Membership applications, renewals, and records.

  • Member contact information and communication preferences.

  • Membership dues, invoices, and payment processing.

  • Membership sponsorships and related requirements.

  • Parent, guardian, and authorized account management.

  • Administrative functions and recordkeeping.

  • Other services made available by participating Clubs.

Connect Outdoors is an independent technology service provider. Unless expressly stated otherwise, Connect Outdoors does not own, operate, govern, or control participating Clubs.

Each Club independently establishes its membership qualifications, dues, rules, policies, and eligibility requirements.

3. Club Ownership and Control of Records

All membership applications, membership records, payment histories, sponsorship records, administrative records, and related organizational records submitted to or maintained on behalf of a Club are records controlled by that Club.

Submission of an application or other information does not transfer ownership or administrative control of the resulting Club record to the individual submitting it.

Each Club retains authority over its organizational records, including the ability to review, correct, retain, export, and manage those records, subject to applicable law.

Connect Outdoors acts as a technology provider and custodian of records on behalf of participating Clubs.

Individuals retain applicable legal rights concerning their personal information. Nothing in these Terms eliminates rights provided by applicable privacy, consumer protection, or other laws.

Termination of an individual's membership or Portal access does not automatically require deletion of the Club's historical records.

Connect Outdoors may retain and process records as necessary to provide services, comply with legal obligations, resolve disputes, and fulfill contractual responsibilities.

4. Member Responsibilities

Members and prospective members agree to:

  • Provide accurate and reasonably complete information.

  • Update their information when changes occur.

  • Use only accounts and records they are authorized to access.

  • Protect their login credentials and authentication information.

  • Report suspected unauthorized access or inaccurate records.

  • Comply with applicable Club rules and membership requirements.

Providing false information, impersonating another individual, or attempting to access unauthorized records may result in suspended Portal access.

Connect Outdoors may require certain contact or identifying information before permitting transactions or account updates.

5. Club Administrator Responsibilities

Club administrators receive access only as authorized by their respective Clubs.

Administrators agree to:

  • Access membership information solely for legitimate Club purposes.

  • Maintain the confidentiality of member information.

  • Use appropriate security practices.

  • Verify the accuracy of information entered or modified.

  • Refrain from exporting, distributing, or disclosing member information without proper authorization.

  • Promptly report suspected security incidents or unauthorized access.

  • Comply with applicable privacy laws and Club policies.

Clubs are responsible for designating authorized administrators and promptly requesting removal of access when an administrator's authorization ends.

Administrators must not use member information for personal gain, unrelated business purposes, unauthorized solicitation, or any activity outside their authorized Club responsibilities.

Connect Outdoors may restrict administrative access when reasonably necessary to protect the Portal, its Users, or participating Clubs.

6. Account Access and Security

Connect Outdoors may use membership identification numbers, dates of birth, session authentication, or other verification methods to authorize Portal access.

Users are responsible for protecting information used to access their accounts.

Users must not knowingly share authentication information with unauthorized persons or attempt to circumvent Portal security.

Connect Outdoors employs reasonable administrative and technical safeguards but cannot guarantee that any online system will be completely secure or uninterrupted.

We may suspend access when we reasonably suspect unauthorized activity, misuse, or a security threat.

7. Minors and Managed Memberships

Membership records for individuals under 18 may include limited information, including name, date of birth, membership status, and information required by the applicable Club.

Connect Outdoors does not intentionally maintain independent email addresses, telephone numbers, or mailing addresses for minor members within their individual membership profiles.

Where communication or account management is necessary, an authorized parent, guardian, or account manager's contact information may be used.

Parents, guardians, and authorized account managers may access limited membership information or perform permitted transactions for individuals they are authorized to manage.

Such access does not automatically grant authority to modify all personal or organizational records.

Clubs remain responsible for establishing appropriate eligibility and consent requirements for minor memberships.

8. Membership Decisions and Club Policies

Each Club retains exclusive responsibility for its membership decisions, including approval, denial, suspension, termination, sponsorship requirements, and membership benefits.

Connect Outdoors does not guarantee that an application will be approved or that membership will be granted or renewed.

Disputes involving Club membership decisions, dues, benefits, or organizational rules should be directed to the applicable Club.

Connect Outdoors is not responsible for a Club's independent decisions, policies, activities, facilities, events, or conduct.

9. Payments and Transactions

The Portal may facilitate payment of membership dues, invoices, application fees, and other Club-related charges through third-party payment processors.

Payments are subject to the applicable payment processor's terms and policies.

Connect Outdoors does not guarantee successful payment authorization, settlement, or immediate updating of membership records.

Users are responsible for reviewing payment details before submitting transactions.

Refunds, dues adjustments, and payment disputes are governed by the applicable Club's policies and applicable law.

Connect Outdoors is not responsible for errors or interruptions caused by financial institutions or payment processing providers, except to the extent liability cannot legally be excluded.

10. Privacy and Confidentiality

Connect Outdoors handles personal information in accordance with its Privacy Policy.

Connect Outdoors does not sell member or administrator personal information.

Personal information is disclosed only as described in the Privacy Policy, including to authorized Clubs, permitted account managers, authorized personnel and contractors, necessary technology providers, and partner organizations where the individual has affirmatively opted into the relevant sharing.

Information may also be disclosed where required by law or reasonably necessary to address fraud, security incidents, or legal claims.

11. Technology Providers and Service Availability

Connect Outdoors uses third-party technology and infrastructure providers, including Wix and Salesforce, to deliver Portal functionality.

These providers operate under their own applicable service agreements, privacy commitments, and security practices.

Connect Outdoors is not responsible for service interruptions, technical failures, infrastructure outages, or data processing delays beyond its reasonable control.

We may temporarily suspend services for maintenance, security, system upgrades, or operational reasons.

While we make reasonable efforts to maintain accurate and available records, uninterrupted access is not guaranteed.

12. Record Accuracy and Administrative Changes

Information displayed in the Portal may depend on records maintained by participating Clubs or synchronized between technology systems.

Connect Outdoors does not independently verify every record, application, membership status, or payment entry.

Clubs and authorized administrators are responsible for reviewing and correcting organizational information within their authority.

Connect Outdoors may maintain transaction logs, administrative activity records, and change histories to support accountability, security, and troubleshooting.

13. Club Departure

When a participating Club terminates its relationship with Connect Outdoors, the Club will be provided an export of its membership and organizational records in a reasonably accessible electronic format.

The Club retains ownership and control of its organizational records following termination.

Connect Outdoors will retain copies of those records in accordance with its standard retention policy, consisting of five years in the operational database followed by five years in a secure archive, subject to applicable legal requirements.

A Club's departure does not restart or extend the retention period for existing records. Each record continues under its applicable retention schedule.

Termination of a Club's service relationship does not automatically result in deletion of historical records.

Following termination, routine access to retained records will be restricted to authorized Connect Outdoors personnel and contractors for legitimate recordkeeping, security, legal, and operational purposes.

At the conclusion of the applicable retention period, records will be securely deleted or irreversibly de-identified unless continued retention is legally required or otherwise permitted under applicable law.

 

14. Prohibited Activities

Users may not:

  • Access records without authorization.

  • Misrepresent their identity or authority.

  • Attempt to compromise Portal security.

  • Scrape, harvest, or improperly extract information.

  • Upload malicious code or interfere with system operations.

  • Disclose confidential member information without authorization.

  • Use the Portal for unlawful or fraudulent activities.

Violations may result in immediate suspension or termination of access and, where appropriate, referral to relevant authorities.

15. Intellectual Property

The Connect Outdoors name, branding, Portal design, software, documentation, and proprietary materials are owned by or licensed to the Portal operator.

Users receive a limited, nonexclusive, revocable right to access the Portal for its intended purposes.

Nothing in these Terms transfers ownership of Connect Outdoors intellectual property to Users or participating Clubs.

Club ownership of organizational records is unaffected by this provision.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Connect Outdoors does not warrant that the Portal will be error-free, uninterrupted, completely secure, or compatible with every device or browser.

Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONNECT OUTDOORS, ITS OPERATOR, OWNERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE PORTAL.

This includes, where legally permissible, lost profits, interrupted operations, loss of business opportunities, and losses arising from unauthorized activity or third-party service interruptions.

To the maximum extent permitted by law, aggregate liability arising from the Portal shall not exceed the greater of $100 or the amount paid directly to Connect Outdoors for Portal services by the claimant during the 12 months preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited, including where applicable liability for fraud, willful misconduct, or other non-excludable conduct.

18. Indemnification

To the extent permitted by law, Users agree to defend, indemnify, and hold harmless Connect Outdoors, its operator, and its authorized representatives from third-party claims, damages, and reasonable expenses arising from the User's unlawful conduct, intentional misuse of the Portal, unauthorized disclosure of information, or material violation of these Terms.

This obligation does not apply to claims caused by Connect Outdoors' own unlawful conduct, negligence where indemnification is prohibited, or other matters for which indemnification cannot legally be required.

19. Suspension and Termination

Connect Outdoors may suspend or terminate Portal access for violations of these Terms, security concerns, legal requirements, or termination of a Club's service relationship.

Suspension or termination of Portal access does not necessarily terminate Club membership or eliminate historical Club records.

Record retention and disposition remain subject to the Privacy Policy, applicable Club agreements, and applicable law.

20. Changes to These Terms

Connect Outdoors may revise these Terms to reflect changes in technology, operations, legal requirements, or available services.

Material changes will be communicated through the Portal or another appropriate method.

Where required by law, additional consent will be obtained before revised terms take effect.

Continued use following the effective date of properly communicated changes constitutes acceptance to the extent permitted by law.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to applicable law, disputes arising from these Terms shall be brought before courts of competent jurisdiction in New York.

Nothing in these Terms restricts rights or remedies that cannot legally be waived.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law or severed as necessary. All remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with the Privacy Policy and any applicable written agreements between Connect Outdoors and participating Clubs, constitute the applicable agreement governing use of the Portal.

In the event of a conflict concerning Club-specific service obligations, an executed agreement between Connect Outdoors and the Club shall control to the extent expressly provided in that agreement.
